Is that your poker face?

(side note, I've previously written about this case, however I've borrowed from both prior posts, in order to give a more well rounded single post here---
previous posts: letters-from-myspace.html

In November of 1995, a then barely known Iranian born California resident was convicted for violations of California penal codes 243.4 D and 647.6. Those charges amount to:

Penal Code 243.4 D--- (d) Any person who, for the purpose of sexual arousal, sexual gratification, or sexual abuse, causes another, against that person's will while that person is unlawfully restrained either by the accused or an accomplice, or is institutionalized for medical treatment and is seriously disabled or medically incapacitated, to masturbate or touch an intimate part of either of those persons or a third person, is guilty of sexual battery. A violation of this subdivision is punishable by imprisonment in a county jail for not more than one year, and by a fine not exceeding two thousand dollars ($2,000); or by imprisonment in the state prison for two, three, or four years, and by a fine not exceeding ten thousand dollars ($10,000).

Penal Code 647.6--

(a) (1) Every person who annoys or molests any child under 18 years of age shall be punished by a fine not exceeding five thousand dollars ($5,000), by imprisonment in a county jail not exceeding one year, or by both the fine and imprisonment.

(2) Every person who, motivated by an unnatural or abnormal sexual interest in children, engages in conduct with an adult whom he or she believes to be a child under 18 years of age, which conduct, if directed toward a child under 18 years of age, would be a violation of this section, shall be punished by a fine not exceeding five thousand dollars ($5,000), by imprisonment in a county jail for up to one year, or by both that fine and imprisonment.

(b) Every person who violates this section after having entered, without consent, an inhabited dwelling house, or trailer coach as defined in Section 635 of the Vehicle Code, or the inhabited portion of any other building, shall be punished by imprisonment in the state prison, or in a county jail not exceeding one year, and by a fine not exceeding five thousand dollars ($5,000).

(c) (1) Every person who violates this section shall be punished upon the second and each subsequent conviction by imprisonment in the state prison.

(2) Every person who violates this section after a previous felony conviction under Section 261, 264.1, 269, 285, 286, 288a, 288.5, or 289, any of which involved a minor under 16 years of age, or a previous felony conviction under this section, a conviction under Section 288, or a felony conviction under Section 311.4 involving a minor under 14 years of age shall be punished by imprisonment in the state prison for two, four, or six years.

(d) (1) In any case in which a person is convicted of violating this section and probation is granted, the court shall require counseling as a condition of probation, unless the court makes a written statement in the court record, that counseling would be inappropriate or ineffective.

(2) In any case in which a person is convicted of violating this section, and as a condition of probation, the court prohibits the defendant from having contact with the victim, the court order prohibiting contact shall not be modified except upon the request of the victim and a finding by the court that the modification is in the best interest of the victim. As used in this paragraph, "contact with the victim" includes all physical contact, being in the presence of the victim, communication by any means, any communication by a third party acting on behalf of the defendant, and any gifts.

(e) Nothing in this section prohibits prosecution under any other provision of law.

For those convictions,Shahram Sheikhan was sentenced to nine months in jail and five years probation for sexual battery and child molestation.

The piece covering the case which ran in the Contra Costa Times, is no longer available for online viewing with out purchase (copy can be purchased here) , but I was able to request and receive a full copy of the report from them:

11/22/1995

Manager gets 9 months for molestation
Byline: CATHERINE HEDGECOCK and CAROLYN MCMILLAN
WALNUT CREEK - The manager of a downtown youth clothing and amenities store has been sentenced to nine months in jail for sexual battery and child molestation involving two teen-age girls he met at the store.
Shahram Sheikan, who goes by the first name Shawn, ran the Diversity store, owned by his family, at 1419 Broadway. The store sells clothing, posters, cards, backpacks and other items geared toward teen-agers.
A jury last week convicted Sheikan of three misdemeanor counts of child molestation for verbal sexual harassment of two girls who were 16 and 17 at the time of the incidents last year. The jury also found him guilty of one misdemeanor count of sexual battery against the younger girl. He was sentenced Monday.
Two other teens testified against Sheikan during his trial, but Sheikan was not convicted on any charges related to them. The jury acquitted Sheikan on two counts and deadlocked on the rest, said Walnut Creek-Danville Municipal Court Judge Bruce Mills.
The girls testified that Sheikan, 26, repeatedly asked them for sex, and became increasingly aggressive after they turned him down. Eventually, he began physically pulling them onto his lap and demanding hugs. In one incident, he put his hands down the younger girl's pants, she said.
"I felt like a piece of meat," she said. "We felt we should stand up for ourselves. I had nightmares about him, and I didn't want other people to have to go through this."
In an interview Tuesday at the County Jail in Martinez, Sheikan said the convictions were "all just a big misunderstanding." The climate of the store was one full of flirtation and sexual innuendo, he said.
"When I first opened the store, we had tons of girls girls and guys who wanted to hang out and be part of something. All day long I would have to hear what guys they wanted to be with. . . they were constantly talking about sex."
He did not deny trial testimony that he tried to persuade the two girls to have sex in exchange for a skateboard, but said he was kidding.
"It was just a big joke and that's why I'm sitting in this hole." Sheikan said. "I am not a criminal. I'm a businessman. I don't prey on young girls."
During sentencing Mills admonished Sheikan for denying under oath that the crimes took place and said Sheikan's testimony was not credible.

That might have been the end of Sheikhan's time in the spotlight for his crimes, and his past could easily have been swept under the carpet. Except that Skeikhan caught the attention of Tom Somach of PokerHelper.com, who proceeded to write a short piece on Sheikan's past, which was picked up by Gambling911.com , Even I have to admit that it's odd for gambling related websites to post about convicted sex offenders, but it just happens that Shahram "Shawn" Sheikhan is a big name in the poker world- big enough in fact that he's appeared on NBC's Poker After Dark.

Some might take this moment to point out that this is the very same network that gave us To Catch A Predator, and my run of the mill commentary on this has been that they must have swapped To Catch a Predator to To Gamble with a Child Molester.

Of course, the story has become more interesting since it first was published, as PokerHelper was on the receiving end of a few words in regards to putting the information out there:

“I am the attorney for Shahram Sheikhan and am writing to you to immediately put you on notice that your previously published allegation about my client is defamatory and untrue,” wrote Las Vegas attorney David Chesnoff in an e-mail. “We are requesting that you immediately print a retraction that he is not a convicted rapist.”

In a news story last week, PokerHelper.com reported that Sheikhan was one of six poker pros appearing all week on NBC’s “Poker After Dark” television show. The story also noted Sheikhan’s criminal past–a sex crime 13 years ago for which he served time in prison, and for which the U.S. government tried to deport him last year to his native Iran.

Even Gambling911 was included in the demands for a retraction:
"The judge knows that Shawn never raped anyone. Rape is a felony, especially against a child, yet the writer states he was convicted on misdemeanor charges. He did not rape a child as the author's piece claims. The poker community knows this, and this amounts to nothing more than a vicious attack on Shawn's character, a man who paid for his mistakes years ago under the guidelines of the law."

Oehring would not comment on the specifics of Sheikhan's case either. Instead, he demanded that Somach's article be yanked from the Gambling911.com website. Somach is one of a series of respected online gambling veteran reporters who allows his content to be reprinted on the G911 site just as Oehring's releases are published on the site as a courtesy to promote his television venture.

A vicious attack on Sheikhan huh? Let's go back to the article printed in 1995- and compare the feelings of one of the FOUR victims, to just how 'vicious' this must be for the Sheik:

Eventually, he began physically pulling them onto his lap and demanding hugs. In one incident, he put his hands down the younger girl's pants, she said.
"I felt like a piece of meat," she said.

Now, if you didn't catch the reference to NBC, or my previous posts on Sheikhan, then you might be in for a interesting twist in this case. It seems that Sheikhan, one of the stars of the Poker After Dark series that airs of NBC, has even been defended by the producer, thinks this is pretty much just insane to be worried about- after all, he's paid for his crime. His profile (linked above) starts out with an interesting slice of information, given his history- I'm not sure if it was the best choice for use as a descriptive of him:
Though a few might heartily disagree, Sharhram Sheikhan, Shawn, to his friends, insists he's a good guy.

Of course, ICE didn't think that it was insane, as they attempted to have him deported last year because of the convictions. Documents from the deportation case are in the links below.
http://lostinlimaohio.googlepages.com/show_case_doc1.pdf
http://lostinlimaohio.googlepages.com/show_case_doc2.pdf
http://lostinlimaohio.googlepages.com/show_case_doc3.pdf

The case for deportation was, according to sources 'in the know' lost mainly because the courts which held his conviction only keep records for 10 years before destroying them. Currently more than one person is in search of any trace of the entire case that might remain, but ICE's case against him has been dropped until further findings.

But that's not the poker players entire story- interestingly enough, it seems that the "Sheik" as he refers to himself on his myspace page, was also responsible for a wreck that took the life of an elderly woman:
One of the two deaths attributed to the storm was the result of an auto accident just after 11 a.m., when a car hydroplaned in the northwest part of the valley.

A Mercedes, driven by Las Vegan Shahram Sheikhan, 29, was traveling at speeds too fast for the slick road conditions on Buffalo Drive just north of Charleston Boulevard, Metro Police said.

The Mercedes slid across the raised center median of southbound Buffalo and struck a Lincoln traveling in the northbound lanes, police said.

The female passenger, 91-year-old Dorathy Ohriner of Las Vegas, died at the scene, the Clark County Coroner's office said today. The Lincoln was driven by Neil Ohriner, 66, also of Las Vegas, police said.

Sheikhan and Mr. Ohriner were taken to University Medical Center with moderate injuries.

I don't know about you, but when I read that Sheikhan 'insists he's a good guy', I have to wonder if he's wearing his poker face as the words come outta his mouth.

Special thanks to Gambling911.com and PokerHelper.com for exposing what just might be the Sheik's worst hand. And be sure to check out Steve Huff's take on the situation at Radar.com, while you're there- be sure to recommend the story.

Letters from Myspace

I told you before about how NBC has swapped catching predators for gambling with them, so the fact that Shahram (Shawn) "Sheiky" Sheikhan is a convicted sex offender should be no surprise. Now, to be fair his 1995 conviction didn't land him on a public notification system... but it did almost get him deported. <--pdf of deportation from Nevada Courts, Evidence Finding here, More Legal Docs here-- and it's been written about by enough media outlets that NBC can't claim they didn't know.

But that's not my point. Cause we've already talked about that. Instead, I have yet another complaint... You see, because he has a MySpace account, I thought it in the best interest to notify MySpace that he had a sexually related conviction for crimes against a minor. So, I reported his page, and sent along a good half dozen related links as evidence of his conviction. And they responded...

Hum... the content has been removed? Interesting, because when I click over to his profile- I still see it, which usually is only the case if it still exists. Which leads me to believe that... OMG MySpace LIED! I know, freaking shocking isn't it? But, I mean- we can't be shocked- not really. After all, if a Network that touts itself as being the start of the movement behind getting sexual predators off the net can turn around and have one starring in a featured show (and getting paid/making money to do it) then we can't be surprised that another company would lie about removing him from their network.

Sex Offenders have low rate of re offending

Every time I turn around I have to hear someone insisting that the stats of sexual offenders re offending is so low. Not just low. But SO low. So low in fact- that it's just CRAZY that the public wants to justify horrid things like sex offender registries. The public is just mean for not letting these poor sex offenders serve their slap on the wrists sentences and then go freely on their way, back into our neighborhoods without as much as a blink.

I'd defend my position that these people flailing these claims around are wrong by giving actual stats from long term studies... but I've done that before. I could defend the cause by clearly explaining that sexual offenders of the 'pedophile' kind are known to have an average of 115 victims PRIOR to getting caught the first time and therefore are even less likely to get caught the second time. I could even defend the SOR by pointing out that studies only catch the ones that are caught and convicted... and therefore they can never be completely correct. But I won't. Because I've done that all before, and it does no good to continue pointing out the obvious to people who would rather stick their heads in the sand and justify their incorrect data with stupid ideas like "sex offender treatment programs work!!!". Instead, I thought I would just play a game of 'show and tell'.

Thomas Edwin Russell, 53, appeared Wednesday morning before Circuit Judge Tom Keith for a bond hearing. The judge set bond at $ 500, 000.

Russell's placement on the sex-offender registry occurred when he was convicted in Washington County of raping a 9-year-old girl.

He currently faces a Washington County charge of raping an 11-year-old girl. A trial is set for Tuesday. NWAnews

Huh... imagine that. A already registered sexual offender charged with... a new offense.
Newport News Police arrested a registered sex offender who they say solicited teenage boys in two separate incidents.

On January 6th, a 17-year-old says Thomas Kahsin, 73, approached him around 8:30 p.m. on the 11000 block of Warwick Boulevard and offered him money to perform a sex act on him.

From Newport News Police

Thomas Kahsin, suspect

The second incident allegedly took place on January 22nd. WVEC

Wow... shocking, another offender charged again in a sex crime.
Police say 28-year-old Christopher Hagan, of Richmond, was doing door-to-door sales in November when at one house he allegedly tried to solicit sex from a woman, and then began touching her. During an investigation into that incident, police say they learned about another victim: a 14-year-old girl from Richmond. WCAX

What do you know... another one.
Heh... and that's just a few in the last few days.

Someone tell me again how sex offenders aren't likely to commit another sex crime...

Wanted ads....

I always wanted to get the chance to write one of those 'wanted' ads for the newspaper. You know the kind where someone is seeking someone else. Personally- I think I'd be rather good at it. I know, you're not sure just how well I'd handle the position- are you? Well, here... I'll give you a glimpse of just how good I'd be:

Well trained, devoted US Marshals desperately seeking sicko sexual predator for long term prison sentence. Perfer Louisville area, but willing to travel. Must be around five feet six inches tall and weigh about 180 pounds, African American, with black hair and brown eyes, and answer to the name "David P. Wheatly". On the edge of our seats waiting to meet. Call 502- 574-LMPD.

I know, you're amazed at my way with words aren't you?

Anyhow, since I doubt I'll be getting that job helping people write wanted ads for the personals... I suppose I'll stick to doing what I always do- sharing the news.

The U.S. Marshals are asking for your help finding a man charged in a sexual assault case.

David P. Wheatly, 41, faces two counts each of rape, sexual assault and sodomy of an 11- or 12-year-old girl in 2006.

Missing...

Usually you get all the headlines for America's Most Wanted's upcoming episodes in one single post, but one of the cases didn't make it to my first post, and after hearing a little about it- I wanted to make sure that I gave it some attention.

It's an all to common story of a broken marriage with less than amicable relationships- that turned into a mystery when three members of the family disappeared.

Ruby Santiago was happily married until she joined the military and her husband Victorio became upset with the lack of time she spent with the family- which included her two sons: Noel and Daniel. As the marriage began to deteriorate, domestic violence began increasing and Ruby ultimately filed for a temporary restraining order against Victorio. That's when things got worse:

Cops say that Victorio went to talk to his wife about the restraining order and ask for forgiveness. Cops say he scattered rose petals all over the ground inside the house in an attempt to charm his estranged wife.

Although Victorio intended to reconcile the domestic issues during that emotional conversation, the couple got into a fight. Police claim Victorio held Ruby down on the bed and punched her in the head.

Ruby, who was in tears and was so injured she had to seek medical care, locked herself in the bathroom. Victorio then drove off with the boys in a car rented from Thrifty Rental Car.

Neither Victorio nor the two boys have been seen since shortly after 1am when he took the children from his Pearl Harbor home. Because he was enlisted, military police began looking for him after he failed to show up to work, and due to the domestic violence claims against him. They have been unable to locate either him or the children.
n their investigation, police discovered questionable notes Victorio left for his family and his colleagues, saying he was sorry for what had happened. In the notes, he expressed how he wanted his affairs handled if he died. Victorio hoped that Ruby would drop the restraining order and they would eventually get back together. He was very apologetic that his marriage had failed, concerned that he had cast a negative light on his profession, and -- most importantly -- he was worried that he would separated from his two boys.

Cops say that Victorio wrote a note indicating that he felt lost because his wife refused to give him another chance. They say he also wrote that if he was to be separated from his kids, then expect the worst: he might end his life. He specifically requested that his body be cremated and that his ashes be scattered near his mother's grave.

For more information on this case, be sure to tune in to America's Most Wanted Saturday at 9 pm on your local Fox station, or click over to their website where you can find details on the case, along with aged progress photos of the children, and descriptions of Victorio.

Things I never thought I'd read...

I'm browsing the news today, and I've noticed an interesting trend- a series of articles that honestly, I never could have imagined reading.

It started with the school teacher Scott Porter - class subject is important here, ANGER MANAGEMENT- who began messing around with a student, and for some unknown reason put the kid in a head lock, told him to 'tap out' or else 'something gets broke' and then... wait for it... broke the kid's finger. The kid claims the finger was broken AFTER he tapped out.

Then there was the bad employee who was afraid she was losing her job after seeing an add in the employment section of the newspaper for a job similar to hers and with a contact number that she knew was her bosses. Marie Lupe Cooley decided that if she was going to get canned, she had every right to make some trouble first.

So, police say, she went to the architectural office where she works late Sunday night and erased 7 years' worth of drawings and blueprints, estimated to be worth $2.5 million.

Now, the problem with this grand plan is that not only did she commit a crime, but that she wasn't really going to loss her job. Turns out, the ad was for a position with her boss' wife's company after all. But, between you and me... I'm just wondering if anyone had pointed it out to her that SHE was looking through employment ads, which normally is done when someone is looking for a job. Ironic?

And the winner of bad behavior in today's headlines has to be Richmond County Deputy Coroner Charlena Graham. Seems that he puts faith in the notion that the dead can't take anything with them... so the living might as well plunder whatever the dead have.
Authorities went into a motel room on Dec. 31 after getting reports of gunshots, a sheriff's report said. In the room, deputies found a 29-year-old woman dead of a self-inflicted gunshot wound. A handgun was in the woman's hand and a handwritten note lay nearby, the report says.

Family reports cards missing
Personal items from the woman were turned over to Graham, including five gift cards for Macy's, Target, Victoria's Secret and a local steak house, according to Sheriff Ronnie Strength. Authorities later learned from the woman's family that some gift cards might have been missing, he said. The total value of the gift cards was about $400.

Investigators recovered videotapes of Graham using the gift cards at local stores, the sheriff said.

Yep, it's clear, people are stupid.

James Allen Selby

James Allen Selby is buried at Ft. Sill National Cemetery in Oklahoma, with full military honors, having served in the gulf war and dying via suicide in October 2004.

But there are some that would like you to consider whether Selby should have the right to be buried in what many believe is a cemetery for those deserving nothing short of honor and respect. Selby lies 'in peace' along side soldier who died while serving our country, or who have died after serving our country. The rest of us are prompted to decide whether just wearing a uniform should ensure one's right to being buried with full honors at a national cemetery... or whether one's entire life beyond their service should play a factor.

You see, Selby was convicted just days before his suicide of 27 counts, including armed robbery, rape, kidnapping and attempted murder- most of these offense stemming from the rape spree he went on after he returned to civil life. He is believed to have at least 10 victims, although some believe there were more, follows is the story of one of his victims:

Jenny Bush, a young Arizona woman just graduated from college, walks into her home at the end of a workday and encounters an armed serial rapist, James Allen Selby. Selby, who had entered through a first-floor window, uses duct tape to gag and bind her, and then rapes her at knifepoint before fleeing.

Anne K. Ream, who heads a victims advocate org- The Voices and Faces Project has an interesting piece in the LA Times about this case, and also about our goverments willingness to allow many others like Selby be buried with military honors, in our National Cemeteries.

The military policy of allowing honors burials for veterans convicted of rape sends a chilling message to victims: Even the most heinous sexual violence does not trump prior military service. It is a position that is as ethically indefensible as it is inconsistent. In 1997, after Army veteran Timothy McVeigh was sentenced to death for his role in the Oklahoma City bombings, Congress barred veterans convicted of capital murder and sentenced to death or life in prison from being buried with full military honors. Veterans convicted of rape or any other violent crime, however, encounter no such restrictions.

The entire piece is really a must read to everyone.

Dead at last...

Before Adam Walsh, there was another young boy abducted, stolen from his family. It was December 4th 1972, and Steven Stayner was just seven years old. He was walking home when a man kidnapped him- holding him hostage for seven years, subjecting him to unspeakable sexual and mental abuses.

Steven was abducted by Kenneth Parnell, a self-proclaimed protestant minister, multiple felon and convicted child molester.

Parnell kept Steven with him, telling people that the boy was his son, and calling him Dennis Gregory Parnell. "Dennis" and Parnell moved frequently around California with Parnell putting him into a series of schools. One of the few positive aspects to come out of Steven's life with Parnell was his dog, a Manchester Terrier whom Steven named Queenie. This dog had been given to Parnell by his mother (who never knew about "Dennis" during the whole period Steven was living with Parnell) on a visit he made a few days after the abduction, leaving the boy in the care of an educationally challenged co-worker of Parnell's, named Edward Ervin Murphy who had been an unwitting accomplice in the kidnapping of Steven and who Parnell had befriended and coerced.

Parnell repeatedly molested the boy, starting with oral sex and moving onto sodomy. Kenneth Parnell babysat for the parents of one of Steven's friends, Kenny Matthias. Kenny's mother, Barbara, who was always fighting with her alcoholic husband Bob, eventually moved in with Parnell and "Dennis." One evening, "Dennis" was invited into bed with Parnell and Barbara, and the nine-year-old boy was forced to have sex with her. Eventually, Parnell and Barbara separated, and Parnell's sexual abuse of Stayner was renewed. (Wikipedia)

Steven was held by Parnell for seven long, unimaginable years- until Parnell kidnapped another boy- five year old Timmy White. Steven's reaction likely saved his life, and Timmy's- as he was able to escape with the younger child, taking him to a police station.

From The Steven Stayer Memorial website:
Steven devoted much of his time upon returning home to telling his story, teaching parents, children and a whole nation how to protect themselves from what had happened to him. His story is told in the movie "I Know My First Name Is Steven".

In 1989, Steven was killed in a motorcycle accident, leaving behind a wife and two young children.

If the shocking nature of Parnell's crime wasn't horrible enough, Parnell only served a few years in prison- a quote from Steven on the subject:

"Before I was grabbed, my abductor had been convicted of child molesting. Throughout my abduction, he never stopped molesting other children. Even so, after taking me from my home, abusing me for seven years and abducting another 5-year old, he served only three and one-half years in jail.

To no one's surprise, Parnell's time in jail did nothing to sway him from his deviant desires, and he was again arrested (in 2004) after attempting to pay someone $500 to bring him a four year old boy. Thankfully, rather than deliver him another victim- the individual turned to police. Parnell was convicted and at age 72 sentenced to 25 years to life in prison.

That sentence is now complete.

Kenneth Eugene Parnell, one of California's most notorious child molesters, has died of natural causes while serving a life sentence.

May he rot in hell.

Woman drowns baby..

There's no name, just the details that the woman was from Wisconsin and 38 years old. She's accused of attempting to drown her twins, although one was able to survive, no thanks to her parenting skills.

A Wisconsin woman has been charged with homicide after allegedly placing her newborn twins in a bathtub and watching them struggle in the water.

A criminal complaint says one of the two-week-old babies died at the scene. The other is expected to survive.

The 38-year-old woman was apparently upset over the shooting death of another son in Texas and wanted to kill herself. She said she was also having trouble breast-feeding.

There's some 'blah blah' about her wanting the babies to go to heaven... but I'm willing to bet that the 'best thing for these babies' was the farthest thing from her mind... or else they would have ended up in the care of someone willing to love them, rather than a bathtub filled with water.

Boy rapes pet

I just have to ask... did anyone else read this? I mean, where the heck where the parents in all of this? I can't seriously believe that a neighbor was able to notice that there was 'animal abuse' in the home, but that the supposed 'parents' that lived in the home didn't.

A 14-year-old Utah boy has been charged with bestiality and lewdness for allegedly raping a dog, according to local affiliate FOX 13.

If convicted, the teen could face up to one year in jail and a fine of $2,500 under state law, which classifies cruelty to animals as a misdemeanor offense.

FOX 13 spoke with Cheryl Smith, executive director of the Utah Animal Adoption Center, about the case. She urged lawmakers to pass stricter laws against people who intentionally harm animals.

What on earth is wrong with these people? I just don't get what could be so wrong with a 14 year old that he would rape anyone- including an animal.

Bad Parents Overseas

In what I hope is just the second of many guest posts by Cat, I'd like to share some highlights from her on just a few of the cases from 2007 that were going on in Germany.

Guest Post: Things you find on Ebay

The following is a guest post by German native Cat. She's a real doll, and was kind enough to allow me to post this here. It seems a current case in Germany proves that America's aren't the only sick people in the world...

I read something really disturbing a couple of days ago in one of Germany's worst tabloids, but obviously other media picked up on it, too. Here's the link for the Germans of an article in the Saechsische Zeitung from January 18, 2008:

http://www.sz-online.de/nachrichten/artikel.asp?id=1719341

And this is the translation of the article for my English speaking friends.

Children offered on the internet - judiciary investigates

Bautzen. In Spreetal near Hoyerswerda, two ethnic Russian emigrants in Germany offered their 2 children on ebay for "rental" for 1000 Euros a day.

The prosecution of Bautzen has initiated proceedings for a preliminary investigation against the mother only, because she is the owner of the email-account, says prosecutor Christopher Gerhardi. Still it is not totally clear yet, that the mother is responsible for the offer. Stating Gerhardi it is also questionable if the elements of an offense for child trafficking are given. For this there would have to be the surrender of the kids in perpetuity. The 11 year old girl and the 13 year old boy were offered in the auction as "well-educated children". They would be missing warmth and affection. But they would offer "an unexhaustible potential of love".

The advertising copy was accompanied by 50 photographs of the life of the children. About 90 customers were interested in the offer, one pressed charges against the parents. Stating prosecutor Gerhardi, the apartment of the couple was searched, but the parents have not been interrogated yet. To the SZ newspaper, the parents Elena and Gregori explained that it was a protest against public authorities.

These would not extend the passports of the family since november 2006. That is why there would be difficulties in every day life. Without valid documents they could not take cash off the bank, they could not license a vehicle or enter into a contract. Even worse, so the father, is the fact that they are not able to visit their relatives abroad. After a long fight without success he wanted to point his problems out to public taking these actions. Gregori explained that the day the offer appeared on ebay (Dec 16th, 2007), he also informed 20 German communication media about his concern. He claims he would have never handed over his children to strangers on ebay. The accusation of offering them for sexual abuse was wrong, he says.

The planned cry for help backfired though. On December 19th, 2007, ten cops came rushing into their house to "save" the kids. Now also the judiciary is investigating.

Now this shit leaves me speechless. No matter how hard things must be for that family and all that, but there is not ONE reason to put up an offer like that on ebay. If they wanted attention, they could have done a lot of other things, since every idiot can get his 15 minutes on tv these days. I seriously doubt that these two did not intend to hand over their kids as long as the price was right. All their explanations sound to me like one big excuse cause they were caught.

Even if they really intended to just get the attention of the media, they should be bitch-slapped for utter stupidity choosing that way.

They put it up on ebay, as a serious offer, put a price in and added 50 pictures of the kids, among them pictures in bathing suite. C'mon, no one is THAT stupid to not be serious about an offer like that.

What I also hope is that the cops and the prosecutor will take a very close look at the people looking at the auction and actually bidding on it. It is scary that out of 90 people only one told the police about the auction.

What pisses me off the most though is that the social services left the kids with the parents since they "could not see a threat right there"...

So you are overworked with your kids and they don't get enough loving from you and not enough attention - you had to have them. Boohooo, fucking deal with it. But you rather have some stranger taking care of your children for money. I don't even want to imagine what kind of attention the two kids would have gotten. I feel overworked, too sometimes, still that would not make me offer my precious child on ebay for 1000 Euros a day. That is some sick shit.

Special thanks again to CAT

Do me a favor...

I don't ask much of ya'll, so I feel it's more than okay to send out this small, painless request. It seems that Corey, from In Cold Blogger has devised a little 'best of' contest- relating to crime. From blogs and bloggers, to books and movies- it's some sort of criminal voting over there.

Now, I was nominated in two categories. But, I'll just be honest with you- I find myself up against two great crime bloggers who are way more deserving. So, I'm asking that you go vote... for them.

Trench, multi crime blogger and the original god father of crime blogging in the "Best True Crime Blogger" category, and Bonnie, of Bonnie's Blog of Crime for Best True Crime Blog .

Congrats to all nominated... and best of luck.

Try to get it right...

Shirley, I'm not one to make a mountain into a mole hill although apparently you are. But, since I'm a nice person and I firmly believe that even the simplest of rabid animals can be enlightened, I'm going to do you a favor.

# Outstanding warrant for violation of probation charge stemming from a 2004 arrest for possession of marijuana under 20 grams and possession of drug paraphernalia.
# Arrested multiple times on various charges, including burglary, carrying a concealed weapon, disorderly intoxication, driving under the influence, indecent exposure, disorderly conduct, fraud, insufficient funds and larceny.
# Arrested in 1991 on charges of a sex offense, fondling a child under the age of 16.
# Registered sexual offender in Citrus County.
# Has absconded more than once.
# Driver's license suspended for 99 years.

And don't forget that this very same person was arrested in Kissimmee in 1991 on a charge of fondling a five-year-old child or that during a house burglary in 1978, John Couey was accused of grabbing a girl in her bedroom, placing his hand over her mouth, and kissing her.

That, my sadly misguided idiot is a tad more than just being a 'two-bit burglar with no history of violence and absolutely nothing to raise red flags'. In fact, it's everything needed to raise not just one, but a lot of red flags. And yet, you would have people believe that the person with that record, the person who later committed a violent and heinous crime in which he kidnapped a child in the night from her own bedroom, help her captive for days while raping her and then forced her into garbage bags- in which he buried the 9 year old child alive in behind his mobile home, was nothing of a danger.

After reading your 'spewed from the mouth of a rotting pile of doo' commentary titled 'Victim and Victimizer: Are They the Same?', I'm left not only with a sickening feeling in my head- but a rare glimpse of a person so confused and demented by the sexual revolution that is currently being dreamed up by rapist, child molesters and other sexually deviant freaks- who would rather the laws regarding sexual abuse of anyone be wiped away so that they can carry on their hearts desires- that she can't see the truth for what it is. Couey was no innocent man lost only because of a drug problem. He was a vile creature waiting for a chance to muster the courage to carry out his heinous daydreams.

You said, and let me quote your insanity on this one:
This case was presented to a nation in such a manner as to induce public hysteria. It is time for us to remember that this is America where that sort of thing will not be tolerated.
For the health and welfare of this nation we had a right to know that the search was for a junkie rather than a sex fiend. Such careless, political power play has done irreparable harm to our country.

Let me remind you... he had a past history of sexual offenses. He broke into that home that horrible night- not to look for drugs, not to steal money... but to snatch a child from her bed. And after fillfulling that need- he didn't trade her for drugs, didn't ransom her out for money to buy drugs- but rather held her hostage for days acting out his cruel sexual desires. And even then, he didn't return her home, didn't walk away from her... didn't even allow her to walk away-

He raped her on this bed, leaving her blood and DNA

he bound her with this cord:

placed her in these bagsAnd buried her alive.

That is not a junkie... it's the deliberate acts of a sexual fiend who cared so little about the life of his victim he willingly tossed her away as if she was trash.

You continue to spew your filth by giving the suggestion of what should happen in families where sexual offender have taken as a victim of their own relatives:
The hunger for revenge is what keeps these incidents as front-burner items. There are high-profile individuals who will tell you that a child deserves what he or she gets if they aren't willing to give up a loved one for 25 years. This is typical thinking for someone who has not experienced the situation. Most kids are not going to buy in to a 25-year future of public misery. We bide our time until we can walk away legally. The family is intact and there is no stigma. It is called survival.

We bide our time? What, the public, the loving members of the family, and the child should just turn their heads, and continue living with the sexual abuse until the child is old enough to walk away? I'm suppose to look at a child and tell her 'I'm sorry your daddy rapes you every night, but just grin and bare it till you're old enough to move out'? What the fuck sort of help is that? NO Shirley, let me tell you how we save that child the proper way- we take the monster who is hurting the child, and send their sorry nasty ass to prison, then we surround the child with love, care and concern- helping them heal by undoing all of the mental abuse they experienced- also known as 'grooming' and assuring them that they aren't at fault for what was done to them. We extend a hand to them, leading them cautiously through their journey to become survivors- and rejoice as they taste life without the constant fear of 'daddy' coming over every night and raping them.

Of course you would see it a tad differently than I would- but I think most will understand it's because one of us is intent on helping stop these sexual predators- and you still open your bed to one.

So, to answer your question: Victim and Victimizer, are they the same?... I have to say, no way in hell.

Aisha S. Bowen, Child Abuser, Video Star

Aisha S. Bowen, 18, was recently caught 'acting out' on a cell phone video. But, unlike many of the girls her age that tend to behave badly when the camera is on them, Aisha wasn't just being stupid and playing around. Instead she opted to physically abuse her 10 month old son numerous times.

According to authorities, on Jan. 13, a resident went to the Ocala Police Department with a Sprint Treo cell phone that he recently had purchased and showed them a video clip of the woman hitting the child. The police report notes that the video shows the child being struck multiple times while being picked up by his arm, and shows him being carried to a bedroom and placed in a playpen, where he was again hit before being forced to lie down.

The video was transferred from the phone onto a CD and placed into evidence.

During their investigation, officers found the phone was previously owned by Jason Crisp, for whom they found an address, and that Aisha S. Bowen was at the same location.

Of course, once Aisha was face to face with the police, she had excuses for her abusive behaviors:

She reportedly admitted she was the one on the video and told police "she was tired and upset" when her son knocked a bowl of spaghetti off her lap while at the apartment. Bowen claimed Crisp yelled at her and told her to hit her son and she did. Crisp, the report noted, was recording and narrating the incident. A witness who was present corroborated Bowen's story. Bowen was taken to the Marion County Jail.

She was tired, and her boyfriend told her to do it. Wow... she ought to get mother of the year for that one.

Of course, Bowen claims to be a proud parent (rather than a child abuser) on her myspace account, Crisp at least was wise enough to keep his claims to himself on his account.

Chandler Rapist Indicted

Since we've been talking about the Chandler rapist lately, I figured I'd offer a happy update to the case against him.

After a year of terrorizing Chandler Az, looks like he might be busy for the next few decades...

Santana Batiz Aceves, 39, who police believe is the "Chandler Rapist," has been indicted on 47 counts, including child molestation, sexual conduct with a minor, kidnapping, aggravated assault and burglary, authorities said Friday.

The indictment, which was handed up by a grand jury, was made public Friday.

Two Rapist Released....

There has to be a better way to handle cases involving children too young or too scared to testify against their rapist. There just has to be. In this day and age- we have too many ways to connect crimes to those who committed them- we shouldn't be solely relying on testimony from children who have already suffered enough at the hands of these vile creatures.

Two men accused of raping children walked free without a trial.

Prosecutors said the victims are young and too emotionally traumatized to testify against the men. The charges will dropped against Ronald Pruiett, 31, and 47-year-old Larry Joe Smith on Friday.

Both suspects in the case have previously been convicted of sex crimes. The men were neighbors of the children’s grandmother.

The mother of the children said one of them contracted a sexually transmitted disease from the men.

And you thought you had complaints about your hospital...

Just a warning, in case of emergency- I don't recommend anyone rushing to the NewYork-Presbyterian Hospital emergency room, that is unless they are willing to be assaulted under the pretense of an exam, and then tossed in jail for a few days for attempting to defend themselves from the intrusive practices.

Brian Persaud, 38, said in court papers that after he denied a request by NewYork-Presbyterian Hospital emergency room employees to examine his rectum, he was "assaulted, battered and falsely imprisoned."

His lawyer, Gerrard M. Marrone, said Tuesday that his client was injured while working at a construction site in midtown Manhattan on May 20, 2003, and at the hospital later he got eight stitches for a cut over his eyebrow.

Then, Marrone said, emergency room staffers insisted on examining his rectum and held him down while he begged, "Please don't do that." He said Persaud hit a doctor while flailing around and staffers gave him an injection, which knocked him out, and performed the rectal exam.

Persaud woke up handcuffed to a bed and with an oxygen tube down his throat, the lawyer said, and spent three days in a detention center.

It seems the construction worker had been injured after a beam fell on him at work, and went to the ER for stitches and to be examined.

I don't care what the hospital claims it was doing... once a patient denies a medical treatment that should be the end of it. What this amounts to is rape, under the disguise of medical treatment.

More on the Chandler Rapist

As mentioned yesterday, the hunt for the Hispanic serial rapist known for attacking young girl in their homes after likely stalking them for days is over.

Santana Batiz Aceves was captured, and it's looking like evidence is starting to tie him directly to the attacks.

A search of the construction worker's belongings produced a work jacket and a silver and black pistol that match the description provided by some of the rape victims, court records released Monday indicate. In addition, authorities also recovered a blue hooded sweatshirt, a pair of dirty tan colored work boots, a steak knife with a black handle, and several toy guns belonging to the suspect's two young children - all of which the serial rapist wore or displayed during the attacks he carried out over an 18-month span, the records show.

Perhaps most incriminating of all remains a swab of DNA material from Batiz Aceves' mouth, which places him at the scene of three of the sexual assaults.

The deviant remains jailed without bond on 25 counts... let's hope it stays that way.

The entire article can be found here, and it's worth reading. The story goes on to make a comparison between the Chandler rapist and the NorCal rapist, sort of putting an end to any speculation that the two are connected. For those unfamiliar with the NorCal rapist, I highly suggest stopping by blogging buddy Stephen's place- Crime Scene Blog, as he's done a incredible job covering the NorCal rapist case.

Baytown Rapist Convicted

Statistics tell us every day that a woman is more likely to be the victim of rape than a man. But behind all the data, the studies and the reports there is the sad fact that even today, not all women will report sexual crimes committed against them. Whether it's fear, embarrassment, denial, self blame or any possible combination of reasons- it's a true to life fact that sexual assaults will always remain one crime that is not accurately reported among women. And if we are willing to accept that women don't always report rapes, we must also accept that men will forgo reporting them also- many times for the same reasons, and many times because they somehow feel that the crime committed against them makes them less of a man. As a society, we have to fight this notion, we have to be willing to accept that a sexually based crime can happen to anyone, of any gender, and any age. And for those that do find the courage to come forward- we have to be able to offer them justice.

For months, a rapist terrorized Baytown Texas, but sadly there were few mentions of it in the news which could have played a role in the time it took to catch him. One has to wonder if the victims gender played a part in the little media attention the cases received. One would hope not.

The serial rapist has been covered here and here.

Keith Hill, after months of committed heinous crimes against men was finally caught by diligent police efforts to crack the case, and has just finished up his 'day in court' so to speak.

A man accused of kidnapping and raping five young men in Baytown during an eight-month spree in 2006 was convicted Tuesday of sexually assaulting a teenager at gunpoint after abducting him from his driveway.

Keith Hill, 20, could receive a sentence ranging from five years probation to life in prison after being convicted of aggravated sexual assault. The sentencing phase of the trial is set to begin later Tuesday.

Knowing that one less predator is off the streets always is a good feeling, but given the suffering of at least one of his victims, I have to clearly state that in no way is five years enough.... I'm crossing my fingers for a life sentence.

The victim in this case testified Monday that he thought he was going to die in the attack that began as he searched for something in his car.

He said he was blindfolded with duct tape, his hands were tied behind his back with zip ties and he was forced in the back seat of an SUV. There the assailant forced him to perform oral sex and hit him on the back of the head with a gun eight or nine times.

Chandler Rapist

I've previously covered the serial rapist of Chandler Az, you can view those posts here: 1 2

The good news of the case is that the suspect has been captured. Love when that happens!

They sifted through more than 2,000 leads, meticulously checked out hundreds of contract or construction workers who matched the rapist's description, and spent countless nights and early mornings on surveillance.

For all the painstaking efforts members of a special task force put into the "Chandler Rapist" case, the big break turned on a tip and a bit of luck.

Continue reading for more insight into the capture of this pervert.

The bad news is that *someone* suspects his arrest will cause problems. I know, I know... you're wondering how on earth the arrest of some vile deviant could possibly cause problems.

Well, first- some "news" station was offended that the suspect was long called a "Hispanic". Regardless of the fact that the man was indeed a hispanic.

And now it turns out that the monster happened to be an illegal... which some fear will cause even more anger.

Experts agree that as details of the reported series of attacks on young girls emerge, they will harden the public's attitude toward illegal immigrants - especially because assaults against children are among the worst types of crimes, they say.

"A single incident like this pushes the debate about smart, thoughtful immigration policies to the side," said Demetrios Papademetriou, president of the Migration Policy Institute, a Washington-based think tank. "There will be no room, there will be no oxygen for rational conversation about immigration as long as the headlines dominate about this horrible incident. People don't forget these kinds of incidents. They may move on, but they don't forget."

Well, I'll be honest- Santana Batiz Aceves's legal status isn't going to sway me from believing that he ought to be locked up for the rest of his *hopefully short* life. And, it's not going to effect the fact that I'm delighted this threat is off the streets... but it does make me question just why he was on the these streets to begin with- we'd already deported him twice prior to this.

Bad Parents Week

I've said it before, and I'll say it again- some people ought to be sterilized. No if and or buts about it, some folks just don't deserve the chance to reproduce.

Here are a few examples:

Man Charged With Killing Wife, Four Children in Ohio

Mom charged in 'possessed' girls' deaths

Search for 2 kids resumes in bridge case

And this one... although the accused isn't a parent- shows so many signs of complete stupidity that allowing them to ever breed would be an endangerment to untold masses.

Baby Dies From Head Injury After Baby-Sitter Swings Him Around in Sleeping Bag

"She put my grandson in a sleeping bag and she swung it around her head and she let it go and let his head hit the metal door frame, fracturing his rear skull," said Debra Needham.

Eye for an eye... or in this case

The unnamed 32 year old man was clearly distraught after his unnamed 18 year old stepson raped the man's 8 year old daughter. And, no one can hold that against him. Of course, the mother of the stepson and daughter evidently didn't feel the same rage as the man, because despite the man's warnings not to bail out the little rapist- she did anyhow.

You just have to know this story isn't going to improve for this family in any way shape or form right now.

Here's the lead up:

The stepson was arrested Jan. 2 and charged with suspicion of aggravated sexual assault. Police say the father caught him assaulting his daughter, and a subsequent examination at a hospital revealed the girl had been sodomized.

The mother then bailed the son out. The step son, upon gaining his freedom made the horrible choice to call home, although instead of reaching his bleeding heart mother, the phone was answered by his understandably angry and emotionally overwhelmed step father, who agreed to pick him up.

Instead of taking the teenager home, the Arlington man drove to an abandoned house in Fort Worth, beat his stepson with a baseball bat and sodomized him with a metal tool, police said.

After the man left, the stepson found a pay phone and called police, who searched the abandoned home.

"We did find evidence at the scene to corroborate our victim's story," Johnson said.

For Ashley

Ashley Howley's mother passed away in February, but her death didn't end the search for answers in Ashley's case.

Ashley Howley originally from Michigan, moved to Columbus Ohio and had started a new life for herself when she disappeared. Her family long suspected that her ex boyfriend played a role in her disappearance, and openly discussed their saddened belief that Ashley had been a victim of abuse that resulted in her death at his hands.

Police never arrested the ex boyfriend, Ashley's body was never found, and after years of unanswered questions- her case slipped into the ever dreaded 'cold case' status. I've covered Ashley's case extensively, and have long hoped that despite the status of the case, one day information would lead to enough answers to solve the case- and bring Ashley home.

But we all know the odds of a cold case being solved, especially a case in which there was very little evidence and few tips to go on. The truth is, no matter how many people hoped for answers, it would likely never be solved unless something major happened. In Ashley's case, that something major may have happened in December... although the cost was the lives to two more people.

SOURCE A 25-year-old man could face the death penalty for the Dec. 26 beating deaths of his mother and her boyfriend in their Minerva Park home.

The Franklin County grand jury yesterday indicted Robert P. MacMichael II on four counts of aggravated murder. One of the murder charges has death penalty specifications.

MacMichael was also indicted on aggravated robbery, burglary and theft charges.

MacMichael has a long criminal record, although charges seemed to have always been dropped or reduced, including a probation violation previous to Ashley's disappearance which involved an assault on her.

Columbus Police also considered MacMichael a suspect in the June 2004 disappearance of his girlfriend, Ashley Howley. She told police on June 16, 2004, that MacMichael assaulted her. She hasn't been seen since June 17, 2004.

MacMichael is charged with beating his mother and her friend to death.

The one I won't cover

Regardless of the fact that it's my hometown- there is a current case going on that I won't be covering. Not that I don't have thoughts on it, and not that I'm going out of my way avoiding the chance to express those thoughts... just that I don't see the point in jumping in a boiling pot before the soup has time to cool.

Last Friday night, Lima police raided a home after investigating drug related crimes. 8 people where in the home, including the suspect. The remaining people in the home where a 26 year old woman, and her six children.

During the raid, police shot and killed the woman, Tarika Wilson and also shot and injured a one year old child. The investigation into the shooting continues, and the drug suspect has been arrested, charged and is currently awaiting a hearing.

You can read complete coverage by the local newspaper.

"Pretty" pedophile won't face jail

In yet another stupid twist of the legal system, it seems that 'too pretty for jail' Debra Lafave will not face any jail time over her most recent run in with the courts. The ex teacher, convicted of having sex with underage student was arrested on a parole violation after 'talking' with an underage girl. Terms of her parole forbid her from conversing with minors.

Fine, fine, fine- I agree THIS shouldn't have put her in jail. But only because I still firmly believe that she should CURRENTLY be in jail on the PREVIOUS charge, back when she was playing the dating game by scoping through the student year books.

Woman Charged in Children's Deaths

5, 6, 11 and 17- too young to have their lives taken from them, and even more tragic because the suspect in their murders appears to be their mother.

A woman found in her home with the decomposing bodies of four girls faces murder charges, and authorities believe she is the victims' mother, officials said Thursday.

Banita Jacks, 33, was expected to appear Thursday in D.C. Superior Court, where the charges will be formally presented, prosecutors said.

"We are working on the assumption that these are her four children," D.C. police Chief Cathy Lanier said at a news conference.

The entire story is worth reading, so click on over.

10 year old rape suspect

Yes, you read that right- police in Springfield Township Ohio are investigating an rape committed by (allegedly) a 10 year old boy. Police say the sexual assault took place in late December at the home where the boy lived. The victim is said to be his 7 year old step sister.

The boy has been arrested.
