Becker County, Minn., District Judge Thomas Schroeder, who had set bail at $15,000 despite prosecutors' request that it be $25,000, told 5 EYEWITNESS NEWS Sunday that he barely remembers the case and isn't sure if he knew then that the man was a registered Level 3 sex offender.
"Usually on a bail hearing you have limited information, and so you set it in an amount that you think is appropriate," the judge said. He said if he had known Duncan's record, he would have set it high enough that Duncan would not have gone free. -

This amazes me as here is yet another case in which the same judge posted a low bond on someone who committed an "against child" crime- A Detroit Lakes man made his first appearance on three felony child pornography charges in Becker County District court Thursday. Source: DL Online District Judge Thomas Schroeder set bond at $10,000 against Christopher Gessell, 26, of 101 Graystone Plaza, No. 202. Gessell is charged with three counts of possession of pornographic work involving minors, stemming from an investigation that began in November 2003.

I am thinking here is a judge that given at least two cases, set bail at low amounts for child crimes. Maybe he doesn't see them as serious. But- don't be so fast to defend the poor judge in this case because a quick search on his name gave me this case: District Judge Thomas Schroeder set bond at $20,000 against Kenneth Andersen, 32, of 37997 280th Avenue. Andersen is accused of one felony count of second-degree arson. Source: DL Online- so evidently a fire suspect is more dangerous to people than men who would conspire to commit heinous acts against our children.

Just WHO are these judges that feel sex offenders are safer than arsonist?? I respectfully request that District Judge Thomas Schroeder step down from his seat before he lets another monster free.

A convicted child rapist from Fargo charged recently with molesting a 6-year-old boy is the subject of a nationwide arrest warrant for failing to keep in touch with his probation agent.
It's believed Joseph Edward Duncan III, 42, is no longer in the Fargo area because the key tag for a vehicle rented in his name was found in a national park in Wyoming, Fargo Police Lt. Tod Dahle said Thursday.
Duncan was the subject of a community notification meeting after he moved to Fargo in 2000 and began attending North Dakota State University, where he was a senior this year.
According to documents obtained from Fargo police before the notification meeting in 2000:
Duncan was convicted in 1980 in Pierce County, Wash., of raping a 14-year-old boy.
Duncan He was sentenced to 20 years in prison, but a judge suspended the sentenced and ordered Duncan, who was 16 at the time of the incident, to enter a sexual offender program.
While there, Duncan told doctors he had his first homosexual and heterosexual experiences when he was 12, forced a 9-year-old to have sexual contact with him at gunpoint when he was 15, and tied up six boys, ages 6 through 10, and forced them to have sexual contact with him when he was 16.
Duncan later told doctors he made up that sexual history to be accepted into the state hospital's program and avoid prison.
A judge revoked his suspended sentence and Duncan began serving his time in a state penitentiary.
Duncan was paroled several times and returned to prison for parole violations, including failing to register as a sex offender in Kansas City, Mo., where the FBI arrested him in August 1997.
He was released from prison July 14, 2000, and registered as a sex offender in Fargo 10 days later.
Duncan, whose last known address was 810 7th St. N., Fargo, was charged in Becker County (Minn.) District Court earlier this year with second-degree criminal sexual conduct and attempted criminal sexual conduct.
He is accused in court papers of approaching a 6-year-old boy and his 8-year-old friend July 3 at a school playground in Detroit Lakes.
Duncan pulled down the shorts of the younger boy and touched him. He tried the same thing with the other boy but wasn't able to, according to the court documents.
Duncan appeared in court April 15 and was released after posting a cash bond of $15,000. He was ordered by the court to stay in touch with a probation agent pending his next court appearance, slated for later this month.
Becker County authorities issued an arrest warrant this week after Duncan failed to check in with his probation agent the week of April 18, Dahle said.
Duncan last checked in with the agent the week of April 11, Dahle said.
The key tag recovered in Wyoming belonged to a red 2005 Jeep Grand Cherokee rented in Duncan's name from a St. Paul rental agency on April 15, Dahle said.
The truck was due back by April 20, according to Dahle, who said he did not know precisely when and where the key tag was found, though he said it may have been at the Bighorn Canyon National Recreation Area.
Park agents discovered the tag while picking up garbage bears had pulled from a Dumpster, Dahle said.
The truck's Minnesota license plate number is NLH 734, he said.
Becker County Attorney Joe Evans said his office is holding off on filing escape charges until more is known about Duncan's disappearance.
"At this point, we don't know what the circumstances are," Evans said.
Fargo police are investigating whether Duncan violated registration requirements, Dahle said.

A convicted sex offender failed to make a court appearance Monday on charges he molested a boy in Detroit Lakes, Minn., last summer.
Becker County District Court Judge Michael Jesse then issued a bench warrant for the arrest of Joseph Edward Duncan III, 42, and ordered that his $15,000 cash bail be forfeited.
Authorities were already looking for Duncan for failing to abide by conditions of release set at an initial appearance in Becker County District Court April 5.
Duncan, whose last known address was 810 7th St. N., Fargo, is accused in court papers of approaching a 6-year-old boy and his 8-yearold friend on July 3 at a school playground in Detroit Lakes.

Duncan checked in with the agent the week of April 11 but failed to do so the following week, authorities said.
Investigators have determined Duncan rented a red 2005 Jeep Grand Cherokee in St. Paul April 15 and failed to return it.
A key tag belonging to the Jeep was recovered in a national park in Wyoming, but authorities have had no other leads, Assistant Becker County Attorney Mike Fritz said.
Fritz said he is contemplating charging Duncan with failure to appear but by law must wait at least two days.

For those many who keep asking who appoint this blatantly unsuitable judge... I have found this from a post dated 7/04 in an online newspaper... please take time to notice the amount he gets paid to let child molesters run the streets:
District Court Judge: Thomas Schroeder is running unopposed for another six-year term. The job carries a salary of $118,400.
